Terms of Service

Welcome to Flenly. These Terms of Service ("Terms") govern your access to and use of the Flenly platform, website, and services (collectively, the "Service") operated by Flenly ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Flenly. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of age or parental consent at any time.

Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We may suspend or terminate accounts that contain false information or violate these Terms.

The Service

Flenly is a timeline-based AI animation studio that enables users to create multi-scene animated videos using natural language prompts. The Service uses third-party AI models (including Google Veo 3.1 via Replicate) to generate video content based on your text descriptions.

Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

AI-Generated Content

Video output is generated by third-party AI models. Results may vary and are not guaranteed to match your exact expectations. AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results despite content moderation measures.

Credits and Payments

Credit System

Flenly uses a virtual credit system ("Coins") to meter video generation. Credits are purchased through our supported payment providers and are deducted each time you generate a video.

The cost per render depends on the AI model selected, the video duration, and whether audio generation is included. Current pricing is displayed in the application before you confirm a render.

Credit Deductions and Automatic Refunds

Credits are deducted at the time you initiate a render. If the render fails for any reason (including AI model errors, content moderation flags, or system failures), your credits are automatically refunded to your account. You do not need to contact support to receive a refund for failed renders.

Subscription Plans

If you subscribe to a plan, you will be billed on a recurring basis (monthly or annually) at the rate specified at the time of purchase. You may cancel your subscription at any time. Upon cancellation, your subscription benefits remain active until the end of the current billing period.

No Monetary Refunds on Credits

Purchased credits are non-refundable and have no cash value. Credits cannot be transferred to another account or exchanged for cash. See our Refund Policy for full details.

Your Content

Ownership

You retain ownership of the text prompts you submit and any configuration settings you create (characters, style presets, project settings). Regarding AI-generated video output, your rights are subject to the terms of the underlying AI model providers.

Content Responsibility

You are solely responsible for the prompts you submit and the content you generate using the Service. You must comply with our Acceptable Use Policy at all times.

Strictly Prohibited Content

Flenly strictly prohibits the creation, generation, distribution, or storage of Not Safe for Work (NSFW) content, including but not limited to:

• Sexually explicit or pornographic material of any kind, including nudity, sexual acts, or suggestive content
• Sexual content involving minors — this is absolutely prohibited and will result in immediate, permanent account termination and may be reported to law enforcement
• Content depicting or promoting sexual violence, non-consensual acts, or sexual exploitation
• Gore, extreme violence, or graphic depictions of injury or death
• Content promoting self-harm, suicide, or eating disorders
• Hate speech, content promoting discrimination, racism, bigotry, or harassment targeting any individual or group
• Content designed to harass, bully, stalk, intimidate, or threaten any person
• Terrorist or extremist content, including recruitment, radicalization, or glorification of violence
• Content that infringes on intellectual property rights (copyright, trademark, etc.)
• Fraudulent or deceptive content, including deepfakes intended to mislead, scams, or impersonation
• Content that violates any applicable law or regulation in any jurisdiction

Flenly is a creative video production tool for legitimate, professional, and personal use only. Any attempt to use the platform for generating prohibited content will result in immediate action, including but not limited to account suspension, permanent termination, forfeiture of credits, and reporting to relevant authorities where required by law.

Content Moderation

We employ both automated and manual content moderation measures to enforce these policies:

• Automated screening: Prompts are screened by content moderation systems before being sent to AI models. Prompts flagged as inappropriate are rejected and no credits are deducted.
• AI model safety filters: Our upstream AI providers apply additional content safety filters during generation.
• Manual review: We reserve the right to review any content generated on the platform at any time.
• User reporting: Users may report content that violates these Terms.

We are not obligated to review all content and make no representations regarding the effectiveness of our moderation systems. However, we take all reports seriously and will investigate promptly.

Enforcement

Violations of our content policies may result in:

1. Warning — for minor or first-time violations
2. Content removal — offending content will be deleted without notice
3. Temporary suspension — account access restricted pending review
4. Permanent termination — account permanently banned with forfeiture of all credits and data
5. Legal action — reporting to law enforcement or pursuing legal remedies where appropriate

The severity of enforcement is at our sole discretion and depends on the nature, severity, and frequency of the violation. We reserve the right to skip warnings and proceed directly to termination for serious violations.

Data and Storage

Video Storage

Generated videos are initially available via a temporary URL that expires after 24 hours. We attempt to upload all videos to permanent storage (AWS S3) automatically. If the permanent upload fails, the video may only be available for the temporary period. We are not responsible for videos lost due to expired temporary URLs.

Account Data

Your projects, scenes, and related data are stored in our database for as long as your account is active. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

Intellectual Property

The Flenly name, logo, and all related branding are the property of Flenly. The Service, including its design, features, and underlying code, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Third-Party Services

The Service integrates with third-party providers including but not limited to Replicate (AI model hosting), AWS (cloud storage), and various payment processors. Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the availability, accuracy, or practices of third-party services.

Limitation of Liability

To the maximum extent permitted by applicable law, Flenly shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or failures
• The accuracy, quality, or suitability of AI-generated content
• Actions taken by third-party services we integrate with
• Unauthorized access to your account due to your failure to maintain security

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to Flenly in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Flenly, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination:

• Your right to access the Service ceases immediately
• We may delete your account data after a reasonable period
• Any unused credits are forfeited
• Sections of these Terms that by their nature should survive termination will remain in effect

You may delete your account at any time through the application settings.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Indonesia.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
